The points most often confused about resignation notice in Malaysia — notice periods, 24-hour notice, and who is covered by which provision.
The notice period in your written contract is what applies. The statutory scale — 4 weeks (under 2 years of service), 6 weeks (2 to 5 years) or 8 weeks (5 years or more) — applies when the contract does not state a notice period in writing. The law also requires the notice period to be equal for employer and employee, and notice must be given in writing.
A 24-hour notice means you are not serving the full notice period. The law lets either party end the contract without full notice by paying the other an indemnity in lieu — the wages that would have accrued over the unserved notice. It is not a free option: check the amount with HR or the Labour Department (Jabatan Tenaga Kerja) before sending the letter, and make sure you understand your contract terms.
Sabah and Sarawak have their own labour ordinances, separate from the Employment Act 1955 that applies in Peninsular Malaysia and Labuan. Since 1 May 2025, amendments to those ordinances carry the same 4/6/8-week notice scale, under their own provisions. The generated letter cites no statute, so it can be used in any state.
No. The general notice provisions (including the 4/6/8-week scale) do not apply to domestic employees. A domestic employment contract can be ended with 14 days’ notice, or payment of 14 days’ wages in lieu, under separate provisions. Use the notice period in your contract, or check with the Labour Department.
